Default Children - permission to remove

We got married 3 years ago. We have 6 children. 3 of Ginni's (ages 17,15,13), 2 of mine (ages 16,13) and one together (age 2 years). Second marriage for us both.

Ginni's ex husband lives (we believe)in singapore. He has no contact with the children whatsover. We do not know where he lives. Pays no maintenance (even though she has court order)

My first wife left me and the children and has never wanted to live with them and pays no maintenance. Sporadic contact twice a year.

We all want to emigrate to Australia and are in the process of compiling all forms ready to put in an application. We understand that we have to show forms that state we have "permission to remove." Does anybody know what this involves? Will we have to go to court to get permission? Will it make a difference if we can't get ex's permission?

Tough one mate, I sympathise with you. From memory I believe that if you cannot get the respective partners to consent to the removal of the children abroad, you will need to get court orders although notarised declarations that you tried to get consent but the respective partners (whilst not refusing consent) were not contactable seem to have worked for some applicants. Suggest you try the sister forum, British Expats - Immigration to Aus/ NZ which will give you a good answer I'm sure.

Hi we are going through the same thing also.. i am an aussie and have been here for 14 years. I married a complete axxxole and we have a 7 year old daughter together he sees her when he feels like it doesnt pay maintanance and he wont sign her passport forms either so she cannot get an aussie passport to remove her from the country. You can apply to remove your kids without fathers consent but it has to be referred to australia and can take a while, other than that apply to the courts to remove them from the jurisdiction which is what im doing at the moment hope this helps in any way...jo
