Advice on end of year summary and super, please

I had been working for my employer, on a part time basis, for the all of the financial year (2009-2010). At the end of June, she decided that she was closing the business and I was out a job. I am still waiting on my end of year summary (as are the other employees) but she is now avoiding my calls. My other part time employer (yeah 2 jobs), said that she was in breach if she did not provide her employees with their summary by 14th July - is this right?
Second question. I never received any super from this employer, and figured I just didn't qualify. I was then advised (and confirmed on the ATO) site, that I was infact, as I had earned over $450 in a calender month. So, what should I do about that? Simply approach her (if she will talk to me
) or are there more offical channels I should go through?
The whole system still confuses me!

but I downloaded e-tax and clicked the prefill button and they had entered it with the ATO so I got it that way.Second question. My son had to follow up lost super, he rang the fund he was in and got forms to chase up the employer. Its illegal not to pay it.
However if they are no longer in business I dont know??
Ring the fund check if the contributions were received and if not they should have advice on what to do.

Hi Kar-Kier,
I would report her to the ATO as it is every employers duty to pay a minimum of 9% super into a nominated fund for all their employees. This should have been shown on your payslips.
Leave a message to your employer that you are going to contact the ATO bet all is addressed quickly.

Yep, employers have until 14th July to issue you your statement. Have you moved address? My employer *forgot* to send mine out as I'm on maternity leave...

I haven't moved. But to be honest I doubt she even knows where I live. I last heard from her on the 28th July, and she said that her accountant was taking her time getting everything sorted! Personally I think that she does not have a clue how much I was paid (all cash in hand), and that is the problem.
If she should have been paying you super and hasn't that you can report her to the ATO who will investigate for you but just remember that she doesn't have to pay your super everytime you get your wages. Employers can make the payment 28 days after each end of quarter
