Default Composer visa...

A while ago I wrote to the group asking about the possibilities of
moving from the UK to the US (California) to pursue a career in film
composition, and it was suggested that it would take 5 years to get a
GC with no guarantees especially as I wanted to avoid labor
certification as I would be freelance.

I havent really got any further with this, but I'm now wondering if I
would be able to set up a Music Consultancy in the US and then
petition myself for a H1b visa? If so, what would this entail?

Any help appreciated.

I am sure if it was that easy then everybody would do it.

I suppose you could set up a Musical Consultany that would be employiing US Citizens but that does not sound what you had in mind.

Obviously UK Musicians/Actors etc do get here, I doubt is any post on this site.

Have your tried the Musicians Union? Or your Agency, would they not know?.

So far from my own research it would appear that I can't petition
myself for an H-1b visa.

I was interested in the provision, under the O visa, for an agent to
sponsor a traditionally self-employed indiviudual, but would that
have to be for a specific job, or a timeframe, or would the first job
be listed and then the visa be open for a year etc. and be updated as
new work arrives?

Also, would this visa allow dual intent so that upon arrival I could
apply for a green card?

A US based agency that provides music to film studio's could petition an O visa for you to come to the US and write music for a specific project(s) or client(s). They would have to be the ones that pay you. Also, O visas are not that easy to get.

O visa and dual intent is a bit of a grey area. As far as I know, while an O visa itself does not specifically have dual intent, it does fall under the doctrine of dual intent. In other words, make sure you get a good lawyer.
