Section 104(c) of the new H-1 law, states that " any alien who--
(1) is the beneficiary of a petition filed under section 204(a) of that Act for a
preference status under paragraph (1), (2), or (3) of section 203(b) of that Act; and
(2) is eligible to be granted that status but for application of the per country
limitations applicable to immigrants under those paragraphs, may apply for, and the
Attorney General may grant, an extension of such nonimmigrant status until the alien's
application for adjustment of status has been processed and a decision made thereon.
Now, here is my question:
By the time my H-1B (six year term) expires, I hope to have filed an I-140 petition. If
and when I file the I-140, I am obivously "eligible to be granted that status." Now, since
I am an Indian citizen and therefore subject to the per country limitation, am I eligible
to apply for a one-time one year extension?

If it has been at least a year since your Labor Certification was filed, yes - and it's
not just a one-time one-year extension, but rather you can keep extending it until your
Priority Date is current.

If it has been at least a year since your Labor Certification was filed, yes - and it's
not just a one-time one-year extension, but rather you can keep extending it until your
