ILR help!!!
I am married to a british citizen, and we have 2 kids.a daughter(which is step daughter of my current husband) and a son.
My daughter is not a resident of UK but has her ILR . Eventually because of some reasons she wasnt able to travel to UK since 5-6 years. And we are planning to call her here for further studies. She is going to be 20 now but she got her visa when she was a dependent.
So what should we do now? What visa do she need..?? what will be the process.?? please help
Thank you

Re: ILR help!!!
According to your other posts you have already been refused a returning resident visa for the UK and had refusals trying to enter the UK.
As your daughter has not been resident in the UK for 5 to 6 years the ILR has lapsed and she needs a different visa to enter the UK.
If she is going to study then maybe a study visa?

From what you have said I would say your daughter's visas are now lapsed. She has been out of the UK for several years.
There is no reviving old visas - you need to apply for new ones.
As your daughter is 20 she is now an adult. She needs to apply for a settlement/study or any other visa in her own right. She is not a dependent or child.

Your daughter will need to show that she has strong links to the UK.
If your daughter wishes to study in the UK, why not apply for a student visa?

Isnt there a rule saying that those who have had settlement visa before ..like we got the settlement visa in 2006, that they can apply for it again, like we are planning to do for my visa.. is it possible?

Re: ILR help!!!
Of course you can apply again for a settlement visa. There is nothing stopping you from doing this.
However, your previous settlement visas are now lapsed and they will not guarantee you another settlement visa.
In other words you start from the beginning again with financial, accommodation and relationship criteria to be fulfilled.
You are going to find that obtaining a visa is more difficult these days as compared to 2006

Life would be a lot easier now if the OP took up British Citizenship before leaving the UK.

Re: ILR help!!!
Since your family's ILR has expired and have already been refused for a returning resident visa so you will need to start the process from scratch and meet the current requirements. If your daughter wants to study in the UK then she would need a study visa.
