You are making a fair comment in this post. However, just because you think it is wrong or stupid or whatever doesn't make a lawsuit "frivolous."

Jargon can often be useful for short hand communication. However, I find that indiscriminate labeling can obscure ill-logic -- and "frivolous" is one of those terms.

It should also be noted that the "law of unintended consequences" is often at work.
