Hi,

I have filed AOS (along with the forms for advance parole and work authorization) with NYC, which they received on April 25th 2002 - according to my registered mail receipt. I then received a "fee receipt" (cash register type) that indicates the date 04/29/02. My question is about the advance parole: I already booked my plane ticket for a trip home (France) with a departure on 07/29/02 - i.e. after the end of the 90 day processing period for advance parole (i started counting from the day they received my application) Can they, in fact, take more than 90 days? If I still don't have the AP on, say, 07/28/02, and I show up at the NY INS office that day with my plane ticket as "proof", will they give me the AP on the spot, or will they say, "though!"? I suppose there is no way I can leave without the AP - although... isn't the "fee receipt" proof of my status?
I'm starting to get worried that I haven't heard anything from the INS since that little fee receipt - was is unwise to book that plane ticket? Initially, I had indicated on the AP application a "preferred departure date" of 07/01/02 - which I then realized was way off. So i booked the plane ticket for a month later, thinking it would be safer.

Hoping that what I just tried to explain makes any sense... the more time goes by, the more worried I get that maybe something will go wrong with my application. Is there any indication that the NYC INS is more backlogged than usual at this time?

I would not wait until 7/28 to go INS for A/P. Not that you could since 7/28 is a Sunday and they are not open.

I would go on the 23 of July and badger them for the A/P if you have not received a notice to pick it up by then. Take a copy of your I-131 and your cash register receipt. Also bring two more ADIT photographs. DO NOT LOSE THAT CASH REGISTER RECEIPT.

As for leaving with only the Cash Register Receipt, DON'T DO IT. It is not proof of your status you need. The Advance Parole allows you to leave and then re-enter the US without INS considering your AOS petition abandoned. Without A/P the examiner at the POE doesn't even have to let you in if they don't want to because you have immigration intent and are out of status.
