Want to use AP - am I "out of status?"
I have read that it is dangerous to use AP to re-enter the US if you are out of status for 180 days or more.
I am in in the process of AOS - my tourist visa expired in June 2001 and I filed I-485 in the same month last year.
We have our interview on August 22nd a year later. For the period of time INS has been processing my application am I "out of status?".
I have a trip to the UK planned for early November and have obtained an AP document (before interview was scheduled).
Is it safe to use AP if the green card is granted but is not immediately available. I have heard of lengthy IBIS delays.

No If you file AOS while in status, then you are not out of status

No you are not out of status - once you have an application filed the clock stops on
unlawful presence
As for the green card, they will stamp your passport with the equivalent of a green
card once you're approved (usually at the interview).
You can't use the AP doccument once you're approved but with the passport stamp
you'll be fine.
