visiting US while waiting for marriage visa

Default visiting US while waiting for marriage visa

Has anyone successfully entered the US on a visa free waiver while waiting for a marriage visa to process?

My wife and I married in August 2003 in England, and we filed for the I-130 and the I-129F in early September via the Missouri Service Center. Rather than sit and wait for processing to complete in England, we were considering flying her here for a 60-day visit or so. It seems this is formally permitted:

However, we wanted to know if anyone had actually done this successfully, and what were the factors that made it a success or a failure. We would hate to waste the money, the time, and the stress if it was a doomed proposition.

I would try the US Marriage Based Visas board, a bit further down the list. Someone there should know.

It took 8 months for me to DCF an I130 through London and I visited the states on a visa waiver for a week during the process. I was a bit concerned prior to the visit that I might get hassled at immigration, but there were no probs. They didn't ask and I didn't volunteer the info. I think I was asked to show my return ticket to the UK which is fairly normal anyway.
