Default Very Important GC question

I am presently leaving in the UK awaiting my interview for either the v1 visa or petition visa, which we filed since nov 1999. Technically I should be due for the V1 visa interview from november this year(3 years after applying for gc based on spouse of PR).

however my challenge is that my student visa in the uk expired this january, and have not returned to my home country since. Does this have any thing to do with my ability to have a succeesful interview and visa approval in the uk? or will it affect my interview?

please give opinion urgently, as I have been leaving apart from my spouse and child for about 3years now, though they come here to the uk to visit me about once a year.
