V1 visa facts
 
Can anyone on this chat board throw some light.


I have a green card and If I marry someone who is on H1B can she be automatically eligible for V1 visa after 3 yrs of filing I-130 can she get EAD after 3 yrs?

Probably not. The V1 was only available for the spouses of permanent residents who's
I-130 had been pending for three years when the president signed the LIFE act into
law (e.g. December 2000). I'm not sure why they drew the law like that - I guess they
thought that if you filed now you knew what you were getting into so tough!
