Unique situation-please help!
 
Hello there. I'm in the middle of the stress that is the K-1 visa. My finace and I met in Australia while traveling. We traveled together for two years and have decide to get married and live in the US for awhile. Because we have been traveling, our funds are pretty dismal and neither of us has a permanant living situation at the moment (we will live with my mom in the US until we can afford our own place). All of this makes the application process that much more complicated.

How much emphasis do they put on funds and stability? We are madly in love and want to live and work together in the same country. The last thing we want is to be apart, but because our banmk accounts are both quite crap at the moment because we've been around the world together, is this going to effect the final decison?

Also, my parents have given us a trip to the US Virgin Islands in November, about a week after he plans on coming over... does anyone know if he will be able to go since the K-1 is a single entry visa?

AND, can he work once he's in the US, on the fiancee visa or will we have to wait the horrible tiem perios for the Green Crad to come through after we're married. We both need to work and pay off our debts pretty badly...

One last thing, does anyone know of any agencies or lawyers who can help sort all this out and doesn't cost $2000?!! That would put us in an even worse state if we had to pay that but in the end might get him into the country.

Any help would be great.

No offense meant but what makes your story unique. Somes like at least 1/2 of the stories here of young love unsupported by financial security at the moment.

Have mommy and daddy sponsor your fiancee so you won' t have to live and work in cold England (your words not mine ;-)) They will need to complete an I-864 for him and you will have to do one as well.

Perhaps someone else here can tell you if you need Advance Parole in order to visit the US Virgins Islands. I'm not sure how the INS views visiting our possessions.

If he is lucky enough to get a work authorization stamp at the POE he can work for 90 days as long as he is lucky enough to get a social security card. If no to both or either of the above conditions, then he can't work until he gets the one year EAD Card (not the green card as you assumed). This is filed for at the same time you file for his adjustment of status after your marriage.

BTW do yourself a favor and read the FAQ for the I-129F. Lots of good and valuable info in there.

Sorry, I'm just very new at this and it seems everything I've read shows that most people have steady jobs and at least rented apts they are staying in with bills in their name to prove their "stability".

For your info, my famliy is not rich either, my mom just lost her job she had for 12 years and my dad is a school teacher, so I can't just "mooch" off of them like you assumed. Thank you for pretending you understood my situation though.

Welcome to the forum. I think you will find it invaluable and after reading through the sites Rete recommended and a few of the posts here the whole process will look much less daunting.

Don't be concerned about proving 'stability' to INS. During the k1 process they are not going to ask for bills and probably wouldn't even care if you lived in a tree house. You could use your parents address for now, right?

You will need to prove to them though that you are able to provide for your fiance/husband financially and if you can't meet the requirements they are asking for then you will need a co-sponsor. If your parents can't be co-sponsors then you will need to find someone else who can help you, friends or other relatives. Yes it's a touchy issue and I am sure it feels weird to go up to someone and ask them to sponsor your fiance but there is not way around it. It's got nothing to do with people assuming you are mooching off of your parents. You are not asking them to hand over a pile of cash. Most likely they will never become financially responsible for your fiance but INS needs to know that someone could.

And I am going to stand right next to Roger and probably get flamed just as badly as he did under a different thread today. Rete didn't *pretend* to understand your problem and I know she doesn't need me to defend her at all but I get really irritated with people who show up here, ask for help, get it, don't like the answers for whatever reason and then displace their frustration onto the person who took time out of her life to make yours a bit easier. As you can see (since you are using britishexpats as well), Rete has posted well over 3000 times and I am sure she has answered hundreds of questions similar to yours and she does it again and again. That has got nothing to do with pretending.

Anyway, good luck with the whole k1 process!

Me and my wife (I am the one that went through on the K1 visa, from Canada) are
currently living with her father, we have been ever since I crossed over into the US
on my K1 visa. We don't have any bills in our name, we don't have a mortgage or a
lease, or anything like that. We just pay her father some money for living here every
month. I can assure you that you don't have anything to worry about in this manner.
We just recently had our AOS interview (Adjustment of Status) and all we brought was
information regarding our joing bank account, health insurance and credit card,
that's about it. No problems what-so-ever.

As for a job, you don't need one. You do need to sponsor your fiancee, but if you do
not make enough money according to the INS, you will be required to find a
co-sponsor. Rete was not suggesting you "mooch" off of your parents, she was stating
that they could sponsor your fiance, which you will need a co-sponsor if you do not
make enough money (IE have no job). If your parents do not make enough money either,
well you will have to find someone else to co-sponsor your fiancee.

Do as Rete suggested and read the FAQ, as well as the websites that were included in
her post. They will be very helpful.

I didn't mean to sound ungrateful, I was just very frustrated last night, I'm sure you'll understand that... thanks for the advice. I have some stocks and bonds put away and some other securities from when I actually DID make money, will that help? And I have tax returns from the past few years where it shows my earnings. Anyway, thanks again...
