That is also my understanding

https://www.gov.uk/new-state-pension/how-its-calculated

You’ll usually need at least 10 qualifying years on your National Insurance record to get any State Pension.

You’ll need 35 qualifying years to get the full new State Pension.

The 3 year rule relates to expats. You must have paid 3 years contributions prior to leaving the UK in order to qualify to pay voluntary payments from overseas.

If you are thinking of contributing another 30 something years, remember the UK Government has moved the goal posts many times on pensions.

Thanks for the qualifier -- the OP's query wasn't clear as to just what he meant -- being eligible for the pension in general, or being eligible to make voluntary contributions.

Pretty sure this is incorrect. For example, let's say you qualify for US SS through 20 years of contributions, but have only 8 years UK, you can use your US record to qualify for UK state pension. There is no "transfer" per se; your UK state pension will still be based on 8/35ths of the full amount, but at least you'll qualify. Check out page 7 of the totalization agreement:

I have no idea. I recall another post on here where someone was told by the pensions helpline that they couldn't make voluntary contributions because they had not paid 3 years before leaving. A quick search failed to find it.

As will all advice on here. Trust but verify.

You can pay Class 2 (or 3) NICs if you are employed or self-employed abroad and if you satisfy the following conditions:

• you have lived in the UK for a continuous 3-year period at any time before the period for which NICs are to be paid - (if you have lived or worked in another EEA country or in Turkey, time spent there may help you to meet this condition)

before going abroad you paid a set amount in NICs for 3 years or more (this will be checked when you ask to pay Class 2/3 NICs)

• immediately before going abroad you were ordinarily an employed or self-employed earner in the UK

Well all I can say is the opinion of not being able to use the credits if you qualify for one pension to qualify for the other is something I've been told several times on BE. It is also consistent with Mrs L's experience in trying to use her SS credits for the UK State pension. She eventually got a UK State pension based on 60% of mine.

Mind you I always thought that what that publication outlines was the way it was done until we tried to get Mrs L's pension.

If she qualified for a UK state pension based on being your spouse then I don't think the totalization agreement would come into play:

"If you meet all the basic requirements under one country’s system, you will get a regular benefit from that country."

Your wife met the basic requirements by virtue of being your wife (no longer the case for newer retirees, I note...).

Just wanted to clarify that a spouse cannot get any benefit of a UK state pension based solely on their partners' UK state pension.

Is it correct that was eradicated?
