It clearly is an outrageous case, it's very difficult since Zadvydas v. Davis for ICE to hold onto anyone for more than six months and more than two years is quite rare, they have to show there is a reasonable chance of removal and that they're pursuing it. Like it says in the article, the only reason he was held so long was because of his insistence that he was a US citizen, if he'd agreed he wasn't, he probably would have been released on bail early on.
That is a perverse outcome.
