No there isn't. You can substitute experience for a degree. But in any event, as said by TexanScot above, none of us can possibly know the case that was put forward or what qualifications the applicant did or didn't have. Speculation about somebody that you think may have got a visa fraudulently really doesn't help anybody.

Since you transferred within your company could you transfer back to UK office if it came to that? Or would you have to sever ties with this company and go back to UK and find another job?

I'm pretty sure they would sort something out but either way, not too bothered. Might go and bum around in my wife's village in northern Thailand for a few years. But if they gave me a UK based WFH gig, That would be really tempting.

I stand corrected then. I just don't understand how he got the green card. I don't care from either end.

Given it more thought I don't think trump will axe or suspend any visa groups per say he will just increase the filing charges many many times over which would have the same effect in many respects.

He won't.

Changes to the fee schedule have to go through rulemaking, and he was very explicit that whatever it is he will be doing - and we still don't know the details - will be done through an Executive Order.

..and I do think we're at an advantage here and we do plan on tying the knot very soon. But I don't want to get complacent. Do you think there would still be a risk after we're married? We'll still need to go through the actual process of AOS etc

It sounds like there will be exceptions for spouses of US Citizens but I'd still be tempted to get married ASAP and get your AOS application filed, it can't do any harm and it'll free you from being on a L-1B.

I don't see how it's possible to progress a new AOS case right now whilst ASCs are closed, since there's no way for USCIS to collect biometrics.

I've been reading of cases on other forms where the agency has been waiving the requirement when they already hold acceptable biometrics from a prior encounter (e.g. from an EAD), but that doesn't help anyone who has never provided them to USCIS before.

My girlfriend would also like us to get married - and it's something that's definitely in our future - but I don't think I'd be able to get through AOS.

All the uncertainty at the moment is just really frustrating.

NY Times saying new green cards likely suspended but not worker and temporary visas. Exemption also likely for GC dependent kids. Still developing...

I was wondering about the biometrics. Our biometrics appointment was for the end of March but was cancelled. Our EADs showed up this morning but where the fingerprints should be, It says fingerprints not available. I think USCIS should have our fingerprints from L1/2 appointments. I guess that our L1/2 renewal is not going to go anywhere fast but if they leave the application open, I think we get 240 days grace on the L1 PED plus we have the I485 status and EAD as backup. I guess the only thin we can really do is just see what happens.

Not quite sure of the details of Biometrics but if its finger prints and photographs, isnt this information gathered each time an entry to US takes place? I know each time I visited from UK on the VWP prints and pics were taken at Passport Control, Newark Airport. Also, do Biometric Passports fit in to all this?

What exactly are Biometrics?
