Travel to US - expired passport
 
Hi,

Am wondering if anyone has any experience with a situation like the below. Dual UK and US citizen, living in UK. Looking to renounce US citizenship but complying with filing 5 years worth of tax returns before doing so. Has a US passport which has recently expired and looking to travel to the US in next few months. Don't want to renew US passport when going to renounce in next year or two.

Have previously travelled from UK to US on US passport and returned on UK passport. Would there be an issue just travelling on UK passport, taking US passport and explaining situation?

Any thoughts much appreciated!

There should be no problems at all using ESTA (if applicable) and the UK passport.

But OP is a USC, so ESTA is probably not applicable until he/she has renounced.

OP is ALSO a UKC. Whereas they SHOULD travel on a US passport, they COULD travel on the UK one.

That is actually against US law, whereby US citizens are required to use a US passport to enter and leave the US, so it may, or may not lead to a problem (may or may not even be noticed) for the OP at the immigration desk on arrival in the US.

If the OP is able to get an ESTA it may be worth chancing it, but it isn't a zero risk option.

I suspect that a recently expired US passport would be accepted by US immigration (a US citizen cannot be denied entry except under the most extraordinary circumstances e.g. being a terrorist), so perhaps obtaining an ESTA and using a British passport to board the aeroplane, then showing the recently expired US passport to enter the US would be the easiest and lowest risk option.

That's the issue. How does one travel to the US as a US citizen but without a valid US passport?!

US Citizens MUST use a US passport to enter and leave the US this is the law, and without a US passport it's likely that you wouldn't be allowed on the plane.
