Refering to the couple who filed the I-212 and I-601 (USC Husband and Deported wife for entry by misrepresentation - my case) where did they file the waivers and how long did it take for them to be approved. I have my interview end of October in Montreal and i am really looking for some inormation.

In the case that I am referring to,the wife was in Guatemala. She needed the
I-212 and the I-601 waiver. I can't remember where they filed the 212 but I
know they filed the 601 through the ins in Guatemala as I recall. In the case
of my husband who was deported, he only needed the 212. We filed the marriage
application, (I-130) and when it was approved, we filed the 212 application.
Both went through the Vermont Service Center. We didn't have the interview
until both applications were approved. We filed the 130 in May 2001 and it was
approved in August 2001. Our waiver was filed soon after that and it was
approved January 2002. Interview in Guatemala in February and visa issued the
same day. Seems a waste of time to have an interview when you know they are
going to deny a visa until you have waiver approvals.

Did your paper work go through the National Visa Center, and how did you know when and where to file your I-212. where did you file the I-212.
all this is still mixed up for me.

My recommendation is to have a lawyer help with the waiver. Both the I-130 and
the waiver were processed through the Vermont Service Center. Once the
marriage application was approved, it goes to the National Visa Center. The
waiver, I believe, was processed through Vermont and then sent to the
consulate.

Hi Toni Thanks for your replies I am happy for them. I Think it is kind of Late or me to find a lawyer since my interview is in a week time this will give any lawyer so little time to prepare. Did you have to write a Letter of Hardship and if so could you give me some tips. My husband used the tips on Doc Steens web site but any additional tip would be a big help. My husband had called the consulate in montreal and was told that the waiver has to be submitted at time of interview (we tried submitting it before to the consulate but it was sent back).
