Timings & Intent to domicile
Hi,
Everyone here has already been a great help and my application is coming along nicely. I have another piece of advice to ask for regarding timings and intent to domicile. I'm currently at the stage to book the medical and send in the DSC230 and DS2001 forms. From looking at other timelines if I pushed on with the application I could probably expect the Interview/Visa by end of Jan, mid Feb.
We plan to move to the US fully in Mid-May. As an aside we are also going on an unrelated 2 week trip to the US at the end of March.
My concern is that at a Visa interview in Jan/Feb it’s going to be a lot harder to show intent to domicile than if I have it in April. I won’t have resigned from my job by then, won’t have given notice on my flat etc. Also, if I get the Visa pre March I'm going to enter with it on the March trip with a return flight ticket, and come back to the UK a couple of weeks later.
Am I better off trying to slow down the Visa application (but risk delaying my Mid May move) or push ahead with it as my concerns about intent to domicile and the march trip shouldn't cause any issues.

Don't forget the visa will be valid for 6 months from the date of the medical exam, so if you do want to slow things down, don't attend the medical yet. Otherwise you leave too little time after the visa interview to have a valid visa.
But I don't see any reason to postpone anything, in my opinion.

You are correct, my wife is a USC living in the UK. She will face the same problems showing intent to domicile 4 or 5 months before we intend to.
How have other people shown this with this kind of lead time? Most of the ideas I have seen on the site such as resignation letters, terminating flat tenancy, job and house searches in the US don't apply so well to a leaving date so far in the future.

However, it's not ideal now when I'm about to submit the evidence for Removal of Conditions. There's kind of a gap in my documentation for those first months... As we didn't really have all those joint things in England that we have here. In hindsight I would have probably delayed the visa. But I think you'll be ok either way, don't forget to collect documents so you're ready for I-751 Removal of Conditions... good luck.

Also keep in mind that if you become a US PR, and then do any selling of property back home, you then become liable for it on your US tax return (whereas you wouldn't have been if you sold prior to becoming a PR).
Just some things to keep in mind to help you make the decision.

Seems like neither thing (less evidence of intent to domicile & March return trip) are going to hinder proceedings so I should carry on with the application as normal.

1. Quotes for shipping your stuff to the USA
2. Letters of resignation (you don't have to turn them in, just have them ready)
3. Proof of house/apartment/home hunting in the USA
4. If staying with relatives initially, get a letter from them stating so
5. Bank account in the USA
6. US ID of some sort...driver license, voter registration, etc
7. Proof of researching schools for the children (if you have any)
8. Proof of intent to sell or rent out your current UK residence
9. Change of address ready to send out to various companies/people/agencies

I am sure that every situation is different and would never encourage anyone to assume anything but just to let you know that in our situation( I am the USC ) my hubby and i went to his interview last Monday 19th.We were armed with proof of intent to domicile- a possible job interview for me,proof of accomodation etc- and to be honest they didn't ask for ANY written proof.They only seemed concerned about the joint sponsor and what she earned.He didn't even ask of our intentions to live/work once we got there.Which surprised me as although i have US citizenship i have only lived in the US 2 yrs out of 40 and that was 10 yrs ago!.So by all means take as much info as you can as you never know what you will be asked.Just saying what happened in our situation!
