There are exceptions, but those come more into play when you are talking about a master artisan or craftsman who is widely recognized as tops in his field kind of stuff.

It is really a bear I'm sorry to report.
It is indeed. And the other fly in the ointment is that the spouse of an H1b is not allowed to work (unless he/she gets their own work-authorised visa).

I would try to live somewhere else. I hate to be so blunt, but it is so difficult to move here. You would be better off investing your time and money into another country's immigration process. At least that would lead to eventual success. Good luck!

I am under no illusion that entering into the USA is an easy process and I quite understand this and respect that it should be tough especially in todays society.

Both myself and my husband turned 30 at the end of last year and we feel that we are ready to leave the rain behind in Scotland and start a new life somewhere, where we can enjoy sunshine and we really love the American way of life. I know it has its problems like most places on this earth and we are not taking the decision lightly as we have a 9 year old son.

My husband is a self employed engineer and I am a Freelance make up artist, how easy would it be for us to work over there and what would be the best visa for us to apply for. I know the UK are exempt for the Green Card, but I know we would both like to continue our careers if we do move. Any help y ou give me is greatly appreciated.

Thanks
Not another one. We're FULL!!!

does anyone have any experience with L1 visas as what I have read says that we could keep our business back home open another one here and I could work on this and we would be looked at after a maximum of 7 years staying for a green card? Does this sound right?

The L-1A intra company transfer is a possible if you employ enough people in the current business... a minimum would normally be around 10/12 ...

How big's your company?

There geared towards mutlinationals, that doesn't mean you need to be one, but if your a small family type business, your going to get far more scrutiny.

I'm not sure that the L1 applies. Don't you have to be moving to a sister business established in the US for an L1 and you have to have been employed by the same company in the UK for at least a year. I don't think they'll buy it if you don't already have a US business to move to.

Not at all .... If a UK company with a fair size workforce selling woodchips
can send it senior staff to the US to open a woofler valve shop
and I believe its now six months prior working for the said UK company ..

There is no requirement for the same or similar business ..
