"Every one of them was warned of that in their earnest money contract, in the deed they received, in the title policy they bought," he said. "And whether you like it or not, neither the Constitution of the United States nor the state of Texas nor any law permits you to have a structure on state-owned property that's subject to the flow of the tide."
California and Oregon have similar laws.

Sad, but it's a risk of owning property bounded by the high tide line. If the high tide line moves, so does the boundary of your lot. Someone somewhere else might have gained some land...

There's going to be a round and round in a loop with this one! Chicken and egg syndrome.
The thing which I wonder if it will resurface at all are any sort of lawsuits regarding Katrina claims?

The article also goes on about beachfront "homes" but fails to mention that the vast majority of the shorefront houses destroyed by Ike were second homes and vacation rental properties - it's not like the owners are all homeless now.

Anyone who builds a home on a Gulf Shore Beach has either too much money to throw away, or is reckless. Apart from that, it makes the coastline ugly!!
Here in Pinellas County, on Gulf Blvd, you could be forgiven for believing you were driving through any large City, in some places you are no more than 75' away from the Ocean, but cannot see it because of all the Apt buildings and condos!! Ugly, Ugly, Ugly
