Tax Return - Does the Missus need a TIN or SSN?
 
Hi All,

A quickie question - does Her In Doors need to get a Tax ID Number (TIN) or SSN before we can send in a joint filing tax return?

There's a reasonable rebate to be had for us, and we'd rather have it sooner, not later!

Yes!!

So best we get her in doors sorted with a number then...

- er, this is not tax advice, so if you're going to sue me, do it for something else (ideally something juicy...!), plus, I have an inoperable medical personality condition which means I wouldn't be able to stand up in court, or something...

If she is eligible for an SSN she should have an SSN. Only people (which generally includes legal people such as companies) who are not eligible for an SSN get a TIN.

Assuming she is here legally on a visa she should be eligible for an SSN.

as an L2 she is eligible for an ssn. Any L2 kids however will not get an ssn and you will need to fill in the form applying for an ITIN and submit it with your tax return.

The ITIN process looks very easy but if its not exactly right they reject the application. Our tax preparers KPMG filled in ITIN forms for us and they were rejected twice before i took it into my own hands and sent in what I thought the ITIN form wanted and got them approved. It meant our tax form was not finalized until something like sept and we had to file an extension for it whilst the ITIN were all sorted out.

Also for others (since the OP's wife gets an SSN) as long as the main taxpayer has an SSN, ITINs for other, non-SSN eligible, family members can be applied for when your tax forms are filed. In fact you are meant to have a reason for applying for an ITIN, so needing to be included on a tax form is a good way of proving this. Get your tax person to apply for them, as you need to provide proof of identity. The details you'll need are listed on the W-7 on W-7 info forms.
