Hey all!

Gordon and I are going to file AOS (8 months and nothing from TSC's I-130) and I
called the IRS for my three previous years of tax transcripts since doofus (the
uncooperative ex) took everything in our lock box when he left last year and they
don't have anything available for me. I can only guess it is because I did not have
any personal income those years. My dad is going to be the co-sponsor for us. Will I
NEED anything for myself since *I* (as the USC spouse) have had no personal income
for the past three years?

HELP!

Your joint income with your ex is your income for the last three years. You can use

Michelle, I would assume you are listed on ex'es tax returns as spouse even though
you had no income of your own. I was in similar position, with only part time
income....gave them his SSN too and they sent me the transcripts.

You need to complete an I-864 even with a co-sponsor. Your ex-husband's tax returns are also your tax returns if you filed jointly. Since you said you had no income he must have filed jointly in order to claim you as a dependent. IRS should have your joint return on file. You will include those with your I-864 even though you had no income to show. You cannot be a sponsor because your ex-husband's income is not usable. If you had income during those years, your W-2 would be the amount used to determine your eligibility as a sponsor. If you own property with assets 5 times or more of the poverty guidelines for your family size of three you could use that to sponsor Gordon.

I have a co-sponsor, but have no tax returns to show my non-existent income for the
last three years. I called the IRS's 800 number to request my transcripts, but since
I was only a depedent, they said none were available for my SSN. I will try under the
ex's SSN and see what happens (as suggested).
