If you read page 3 of the instructions on form 8965 you will see that your husband should file this form along with his tax return (assuming he meets the limits to have to file) to state that he resides overseas and does not need health insurance. Just having a foreign address does not satisfy the IRS that you have been outside of the USA for 330 days, you need to complete the form to make that statement each time you file.
