Having arrived in late March and married June 1st I am about to file all my paperwork. I would like to get my SSN before I send it all off though. It would also help with things like Health coverage on my husbands plan etc.
When I entered the States (through JFK) I asked for the Employment Authorisation stamp but the guy gave me some story about 'not doing that anymore' and so I dont have Authorisation to work currently. I understand that as a K-1 I am eligible for a SSN anyway without this but the 90 day period stamped on my I-94 is now expired. Is this going to cause a problem at the Social Security office? I married in time but I'm really not sure what my official 'status' is right now. Any insight or advice would be gratefully received. |

You are still k-1 status until you file AOS. If the first SS ofice you visit gives you grief on issuing the card, go to another one and try again. Show them the memo and ask them to check their file for their original copy of it, that should help. I'm sorry, but EM-00154 say unexpired I-94 K-1. You might start splitting hairs about what status you are in, but I bet just about every office is going to verify status with INS, so that's going to take about a month for a response, unless as I said they feel like calling INS while you are there. Now what INS tells them is out of my field of knowledge. Take care, Mike :) |
Ros- Sorry to tell you- but one of the first two things you should have done when
arriving here in March, *before* marrying are: going to your local INS office with your K-1 stamp and applying for your 90 day EAD. They may only make them up one day a month like they do here in Baltimore- but if you *apply* before you are married, they will still make one of them up for you, even if the day they have scheduled to do it was after you were married. Marching down to your local social security office with your K-1 stamp/visa in the passport and armed with the afore mentioned memo. That is exactly what we did when my fiance arrived, and he received both no probs. The SS card says work "only with INS documentation", but that's fine because he also has that. We were married a little over 2 weeks ago, and plan on submitting our AOS stuff by the end of this week. I fear because you are now married and you did not apply for these documents whilst you were still a k-1 *fiancee*, and not an alien wife- which is what you are now, you may well have to wait until you have adjusted status (or at least applied) to get the proper SS card with your 1 year EAD. Or maybe not- its worth a try. Good luck. Beth ---------- [usenetquote2]>> > Having arrived in late March and married June 1st I am about to file all my[/usenetquote2] [usenetquote2]>> > paperwork.
