Spouse visa for Ameircan Citizen
I just found that a guy went to american embassy the place he got married in Aug 16th 2002 and applied for the I 130 for his wife and on September 17th his wife recieved a letter calling for the interview from the ameircan embassy in Madras India. My question is does they also have a IBIS checks? Can we go and apply at the american embassy were we got married again if we already applied at the Vermount service Center?. It looks like it is faster to apply in the place were your spouse is.
Also the Missouir is slow also on the k-3 process as well. regards kindia. |

I don't know about now since your paperwork is already in the process. One
of the other members might be able to tell you that. As far as going to the consulate in the spouse's country, not all consulates allow that. It is called Direct Consulate Filing (DCF). Each consulate has their own rules as to what they will and will not do. Even to the point on when they will allow the spouse to start the paperwork. Jerry |

I am not 100 percent sure of what you are asking, but you don't need to get married again in order to file I-130 at the consulate. If you mean file the I-130 again, then yes, you can do this. If you do that, please notifiy INS to stop the US based processing of the original I-130. |

I don't know too much about DCF, but I think you have to be a permanent

Bastian And for the OP, yes, you can refile your I-130 at the Consulate in your spouse's country (if they do DCF and you meet the residency requirements or lack thereof).
