South Caroline House of Representatives - Meeting Notice

Re: South Caroline House of Representatives - Meeting Notice
Okay, It's been a while, but that wasn't MY fault!
The SC Senate does a lousy job in keepeing their website updated,
and they don't give out information on the phone...
Anyway, this is the latest:
Senate Transportation Committee
Thursday, May 2, 2002 10:00 am 308 Gressette Building
AGENDA - Senate Transportation Committee Meeting
Call to Order … The Chairman
Screening for Mr. Glynn Furman Willis … The Chairman
reappointment to Scenic Highways Committee
H. 4670 - a bill relative to the issuance of a driver's license to persons from another country
who are in this country on a work or study visa.
Favorable subcommittee report: Senator Hawkins, Chairman and Senators Ravenel and Rankin
Other business
Adjournment

Re: South Caroline House of Representatives - Meeting Notice
I know, I haven't been keeping you informed, but, sofar, the Senate hasn't been
particularly anxious to give out information!
People kept referring me to the website, that they hadn't been updating for a month!!
But yesterday, I had a very nice conversation with Cherith Norman (DeMint's Office)
Believe it or not, she called me! She told me that she was there, at the first hearing,
and she heard me give testimony, and she knew that it was important to me,
that she had a list of people to call, and that I was on it *S*
Anyway, long story short, everything is going to be okay...
except, it's going to be a little longer because she expects that today,
in the committee meeting, the bill will be amended.
Not sure how they want it exactly, but there's going to be a limitation
on the validity of a driver's license issued to an immigrant.
From what I heard, from one year, up to three.
I have no idea if they're going to issue K-1 people a license that has
a three year validity, but I don't really care, do you? I'd go every week
to renew it, if that what it takes to get me driving!! *S*
Anyway, to pick up where I left off: Because of the amendment, the bill
will be accepted in the Senate, sent to the floor, read two more times,
and if voted for, the bill needs to be sent back to the House to be approved.
Cherith told me not to worry, however, because everyone is cooperating
to get this bill done before the session period is over.
Maybe it will take a little longer than that, but Cherith told me that
all that has to happen after that, is signing by the governor,
and he will be there, even if session is over...
She expects to have the new bill in effect by July first.

Re: South Caroline House of Representatives - Meeting Notice
Just got this letter from John Hawkins Senator.
"Subject: Re: Reference to Bill H.4670
Thanks for your kind email. We should have done this sooner.
Assuming there is no opposition to the bill, it should pass next week (hopefully without any
fanfare). Quiet passage is always better than having lots of discussion on the floor. However, I am
ready!
Take care, and please always call me when you need me.
Your friend,
John"
Ahhh, friends in the Senate...what more could one ask for

Re: South Caroline House of Representatives - Meeting Notice
Just off the phone with John Hawkins. He relates the bill passed thru committee UNamended, yesterday May 2nd. It will be read in the Senate on next Tuesday. You may be able to see it on live feed at http://www.scstatehouse.net/senate2.html
He expects it to pass without amendment. All SC drivers licenses have a life span of 5 years, he believes that putting a time limit on immigrant DL's is redundant.
After it passes thru the Senate it will go to the Gov. desk.

More reading on the Bill...

05/08/02 Senate Ordered to third reading with notice of amendments
Have no idea yet what the "notice of amendments means"
Does this look different than the last one?

Re: South Caroline House of Representatives - Meeting Notice
Amendment?
I couldn't find it either... It seems like they left the text the way it's been from the start.
So, my guess would be that what's amended, is the time the new issued driver's license would be valid for.
As I was told last week, that would be a year, up to three...

Amendment
Anyone care to put the following in plain English? *S*
"(7) who is not a resident of South Carolina, --stricken--. except for persons from other countries who are present in South Carolina on a student visa or on a work visa or the dependents of the student or worker who may be issued a license. --stricken--.
For purposes of determining eligibility to obtain or renew a South Carolina driver's license, the term 'resident of South Carolina' shall expressly include all persons authorized by the United States Department of Justice, the United States Immigration and Naturalization Service, or the United States Department of State to live, work, or study in the United States on a temporary or permanent basis who present documents indicating their intent to live, work, or study in South Carolina.
These persons and their dependents are eligible to obtain a motor vehicle driver's license or have one renewed pursuant to this provision. A driver's license issued pursuant to this item to a person who is not a lawful permanent resident of the United States shall expire on the later of:
(1) the expiration date of the driver's license applicant's authorized period of stay in the United States; or
(2) the expiration date of the driver's license applicant's employment authorization document. However, in no event shall a driver's license issued pursuant to this item expire less than one year or more than five years from the date of its issue. In addition, a person pending adjustment of status who presents appropriate documentation to the department shall be granted a one-year extension of his driver's license which is renewable annually."

What happens with these laws is that the state legislature gives the legal framework
for the DMV to produce a more comprehensive set of rules under. So, it will be up to
the DMV to specify what "all persons authorized by the United States Department of
Justice, the United States Immigration and Naturalization Service, or the United
States Department of State to live, work, or study in the United States on a
temporary or permanent basis who present documents indicating their intent to live,
work, or study in South Carolina."
So the "plain English" will have to wait for the DMV. My guess is, like a bunch of
states, they'll list a whole set of visa categories, probably missing off advance
parole because nobody understands it, but for pending AOS it will be EAD or nothing.
It does also state that an EAD can be used but that you'll only get up to the
expiration of the EAD (or a year from now if that's longer).
