Hello all The K-1 FAQ seemed a little unsure about SSN's and EAD's so I figured I
would ask the group for any current info about our situation... We got married this
past weekend and are now in the process of filling out forms for AOS following the
K-1FAQ in general. Anyhow we took a break from the apartment and went to get her
social security number. The clerk who took her information at the Social Security
office was very friendly, in the course of our conversation I asked about the her
card being marked not authorized for employment. He said no this is all she will need
for employment. My question is if the card arrives without the "not authorized for
employment" anotation will there be any point in filing the EAD application with the
$100 filing fee? Also will it screw up the process to file the EAD at a different
time from the filing I-485 and I-131? It seems that waiting a week for the SSN card
to come in would be the most prudent. Is it better to file by mail or drive to
Memphis? We live in Nashville so could make it to Memphis and back in a day. Thanks
for the help. Glad

The work authorised stamp allows you to work for 90 days. You will still need an EAD
else you will be working illegaly after the K1 visa expires.

I think that you have to file by mail to memphis anyway, I would not make the trip.
See this URl with experiences at the Memphis office, read the second experience:
http://www.kamya.com/aos/tennessee.html#memphis

If she wants to work prior to getting the 1-year EAD, she will need a temporary EAD,
which you can confirm by reading the last paragraph on this page: http://www.ins.usd-
oj.gov/cgi-bin/folioisa.dll/lawbooks.nfo/query=[jump!3A!278cfrsec274a12b20!27]/doc/{-
@25358}/words=4?

After you file for AOS, she is NOT K-1 status any more but instead is "pending
adjustment", and she will need the 1-year EAD, as do all aliens who are pending AOS,
see this URL: http://www.ins.usdoj.gov/cgi-bin/fol...oks.nfo/query=[jump-
!3A!27act274acap!27]/doc/{@5561}/hits_only?

alvena I am not a lawyer and this is not legal advice; this is my personal opinion,

She can also go in and get a temp one too. A temp EAD. They are very easy to get and
they are FREE!!! And yes.....the re-new them just as easily here in Portland, OR :)
