Question on Conditional Visa
Me and my wife married in August 2000. Things didn't work out. We no longer live in
the same place. Anyway, what happens when the conditional visa expires? Do we have to both go to an interview? Will they call us in? What if INS finds that we haven't been living together? We came in using the k1-visa. Thanks for any advice you can give. |

If you are a permanent resident (with conditions) then two years (less 90 days) from
the date you became a PR you need to file to remove conditions. The law is kind of strange because if you got divorced prior to that date you can file immediately providing evidence that the marriage was entered into in good faith. If you are not divorced then you have to file jointly. Bottom line, whatever happens, don't lie or pretend you are still together. So long as you can show the marriage was valid you should be OK. You are required to file before the expiration date, not 90 days before. 90 days before is the earliest date you can file, not the latest. |

there are a few of us who have sucessfully gotten the conditions lifted after
