Hi All,

I was going through the requirements for filling up the i129F,and I was wondering:
1. The INS would require 3 consecutive past years of income tax return. Do all of
these returns have to meet or exceed the 125% of current poverty guideline?
2. Has anyone tried using the assets of the immigrant and are there any issues
associated with it?

thanks, Lawrence

No, they do not all have to exceed the 125% requirement. Usually they look the
hardest at the current income/job, and the previous one year's income, however bear
in mind, at most consulates you do not have to file tax returns unless you are
self-employed. You only file them at AOS.

I have heard of some who used assets, and the I-864 affidavit plainly states you
can. Alvena

Alvena,

The original question was regarding the I-129F which means, the 864 does not apply.

I am not positive, but I don't think you can use the immigrants assets any more than
you could use their income, for the I-134 (or otherwise meeting the income
requirements for the consulate) for the issuance of a K-1

It's a non-issue really. The immigrant can transfer assets into the US citizen's bank
account under the US citizen's name, and that problem is quickly solved. Alvena
