QUESTION ABOUT ENTRY TO USA!!
Hey guys. I'm back, and here to annoy you again
On the 16th march I'll have my 8th trip to the USA since July 2012. Never stayed more than 40 days. Basically from the 8-11 march I'll be in Amsterdam.
Am I likely to be questioned by CBP about my trip there?

You will be a lot less likely to have issues if you get yourself a B1B2 visitor's visa rather than use a visa waiver.

Since you are a UK citizen and therefore an EU member and therefore will not receive a stamp when you enter the Netherlands, I don't see why they would a) know or b) care!

Why apply for B1/B2 when VWP/ESTA will suffice? In fact, that's often a good enough reason to be denied B1/B2. And if you get denied B1/B2, you can have problems entering under VWP/ESTA. I would advise continuing use of VWP/ESTA.

If he's VWP eligible he's unlikely to get a B1/B2 unless he's retired. And if he applies for a B1/B2 and is rejected, he is likely to be unable to get approved through ESTA for 6-12 months, therefore no VWP either. So how does that mean he is "a lot less likely to have issues"?

This is among the worst immigration advice I've seen posted here. Having a visa would make little difference. you're either admissible it you're not, having a visa doesn't change that. But the chances are sky high they would be denied a visa because they have no reason to need one and that would screw them for some time while ESTA gets denied because if a visa denial.

I don't think that's the issue, 8 x 40 = 320 so depending on how long you've been in the US the last 20 months total they may think you lack non-immigrant intent.

Also he could near or having passed the "substantial presence test" or the 182 maximum days per calendar year which could complicate things quite a bit.

Last time I visited the Netherlands through Schipol, the border guard didn't even bother taking my passport, he just saw me approaching and waved me through.

For what it's worth when I lived in Cardiff many moons ago the easiest way to get to Philly, where now wifey was then living, was to fly via Schipol. I'd therefore put "Netherlands" as one of the countries I'd been through on the US customs form and I never got asked about it.
