My wife and I have met on three (3) separate times before we got married in Malaysia. She is a Filipino and I'm an American. She had been working in Bangkok for a period of four (4) years before returning back to the Philippines, where she now is awaiting the K-3 visa process. While in Malaysia, we stayed at a hotel for a period of one (1) month.

When I filed my I-130 back in May, I answered question 21 on the form as the instructions stated. I put down the address of the hotel where we had stayed in Malaysia.

Now I have found recently that I should have stated, "Applicant plans to obtain a K-3/K-4 visa abroad and adjust status in the United States" on Question 21 of the I-130 form.

Is this really true? Will it delay processing? And do I need to contact the INS?

When I filled out my 130 I went to the local INS office and they reviewed it for me.
So this is how mine is filled out in accordance to their suggestions.

First of all the instructions are for an older form. That phrase now should read
question 22. On the newer forms question 21 is the address where you last lived
together. The inspector told me that I should put both the Buffalo office down for
AOS in the states and Santo Domingo for the visa. She said the reason for that is to
inform the consulate if the 130 gets approved prior to the K3. I have read this
happening a couple times already. If you do not put in the consulate and the 130 is
approved first, it will then cost you another $140 to file some other form to tell
the INS to let the consulate know.
