Smile Pregnant and Travelling in/out of US on E2

Hi all,

We are living in the US on our E2 visa and are currently expecting a brand new member of the family in July. We have insurance, plan to have the baby over here etc but are due to travel back to the UK for a week in May to visit family before the baby is born (realistically, we wouldn't be able to go back and visit them in the UK until at least 3 months after the birth due to birth certificates, health, passports etc).

My question is, has anyone had any experience travelling into the US whilst pregnant on a non-immigrant visa? Obviously if you're 6/7 months pregnant and trying to enter on VWP there would be issues but i'm a little nervous about getting back into the country once returning from the UK on our E2. Advice and reassurance would be great here!

P.S Just for clarification, we are able to fly at this time and have doctors notes etc so this part isn't an issue. It was more an immigration concern.

It won't be an issue so long as there's no medical restriction that stops you from flying and your visa is valid.


Obviously if you're 6/7 months pregnant and trying to enter on VWP there would be issues...
I doubt it. It's not illegal to visit the US to give birth.


It was more an immigration concern.
Well then, it's not an issue.

Airlines have limits/ restrictions based on how long before you give birth, so you should check the airline's rules.

As Ian said, there is no immigration issue with arriving in the US while heavily pregnant - there is nothing to stop a woman who is 8.5 months pregnant arriving in the US on a private chartered aircraft.

Make sure you have travel/health insurance that will cover you while you are in the UK.

Also bear in mind that if you stay in the US long-term and give birth prematurely in the UK, that your child will age-out of visa status on their 21st birthday and have to leave the US unless they are able to obtain their own visa (if the child is born in the US he/she will be a US citizen). If they had to leave the US it would presumably mean that they would have to return to the UK as a stranger, having never lived in the only country that they are legally entitled to live in.

If it is me I would hold of on the trip until after the baby is born. Baby born in USA is USC under the 14th amendment. Having a duel citizen baby would be optimum outcome here. It would mean you would be free to pursue your objectives without having to worry about the child ageing out of a visa you can live on for years to come.

Here is another question for the discussion. What if she was to go in labour on the plane in midflight what nationality would the child be? I remember the woman giving birth on the plane bound for the america last year and the child was deemed to be Canadian due to location of the plane at the time.
