Default Please help Employment termination

Dear all,

(30/08/02)Yestruday evening i got a mail from my employer that i have been terminated from the company .They have send a FAX to INS regarding the termination ...


1,How long can i stay in the country legally ...


2,Can i transfer my current H1 to another company.


3,How long i need to wait to work if i already got another job.


4,Do i need a new H1 or can i transfer the current h1 itself?


Any help at this time will be more comforting to me .

Yes, you will have to apply for transfer.

You can start working once the new company files for the H1B transfer. Some companies prefer that you wait until they get a receipt from the INS for you case.

Transfer.

You must depart as quickly as feasible ... there is no specific time limit, but less
than 10 days never causes grief ... more than 10 days and it's anyone's guess.

Well ... that's a good question. If you had employment already arranged with another
employer prior to your stopping work with your previous employer, then yes, you can.
BUT since you are instantly terminated, technically, you can't. There's lots of
speculation about how long the INS will actually give you to find a job after you've
been laid off ... belief is it's only a matter of days.

Bear in mind that if you don't get a new job quickly (within days), then the INS
could a) refuse the transfer, or b) approve the employment but refuse the transfer of
your status to the new employer without your leaving the country, getting a new
passport visa for the new employer and then re-entering.

If you cannot get a new job and have the employer file the H1B transfer within 60
days (note that you may have to be out of the country if you don't find the job
quickly). Then you would have to get a new H1B.

Officially, you have to leave immediately. There is an unofficial 10 day grace
period for you to pack your bags and make preparations to return home. Don't
stay illegally as this can only hurt your future chances of gaining legal status
in the USA.

you can make a deal with some company here and then go back to home country and apply on the behalf of that company. a guy also did like this and he was bach in USA after only one week going to home country.
