PLEASE HELP! Canadian need TN visa to stay in US

Question PLEASE HELP! Canadian need TN visa to stay in US

Hi there,

Here is my story, hopefully someone can help me with this.

I'm a Canadian citizen with engineering degree. My boyfriend got a job in the US and I came with him as part of a roadtrip/help him get settled kind of trip. I was planning on going back home in a few weeks. But now that I'm here, I really would like to stay living with him. Both of us have no plans to obtain citizenship in the US. My problem is I don't currently have a job offer and I read somewhere on this forum that we're not allowed to look for jobs while in the US.

I realize some of these questions have been asked already, but I still don't quite understand the US's immigration policies, so please bear with me.

Is there possibly another way to obtain a TN visa?
The job I get has to be an engineering related field?
How much does the company have to pay for sponsorship? it is >$4000 listed on the grasmick website? I was thinking if I can say on my resume that they can take the cost out of my salary. Yes, I know I sound desperate...but only for the person I love.
If I don't get a job offer and don't plan on working, is it still OK for me to live here? ie do I have to leave after a certain period of time?
Can I obtain a Social Security Number?
Can I get a bank account?
If all else fails I was hoping to get hired as an independence contractor, that's legal right??

Well ... that's not totally true that you can't look for jobs in the US ... what is
true is that an officer probably won't let you in if you indicate or have other
things that show you'll be looking for jobs in the US on the grounds that you're
demonstrating immigrant intent.

What do you mean by "another way"? You get a TN by getting a job and have the
company write a petition letter to the INS. The job must fit the categories on the
NAFTA TN list in terms of a related title and duties. Your education must meet the
minimum requirements and must be closely related to the TN category. The letter must
describe that they want to employ you for a year (the employer should understand that
it is extendable, so you can work for more than a year in reality). You get the TN
at a US port of entry, *on entry into the USA*. You can't go to say Denver airport
while you're in Denver ... you need to leave the US and return.

As above ... related to your degree.

The TN costs US$50 or US$56 (air or land port). The $4000 is if you need
lawyer representation. Most TN applicants don't ... but some do, or their
employers want it.

You must leave within 6 months of your date of entry, and you're unlikely to be
allowed back in as a visitor.

With a TN, yes ... without, no.

No, it's not legal at all ... you still must meet the requirements for a work status
... be it H1B, TN ... and you can't work for yourself.

I don't have a social security number and I was able to easily get 2 bank
accounts here.

There aren't enough technical or other jobs for US citizens, far less for foreigners.
The economy in the USA is really really bad now, and you can thank the CEO's who
embezzled billions out of enron and worldcom for that.

Looking for a job here, especially as a foreigner, is not going to land you much
success. Sorry.

In some areas, banks are quite reluctant to open accounts without SSNs ... even with
an ITIN they ofte refuse ... Much depends on where you are.

You can open a bank account without a SSN. You just have to obtain a Tax ID number
from IRS to do so.

As I indicated in another posting, some banks are so poorly informed that the
idea of anyone without an SSN is enough to send them into a tailspin, and if they
meet anything that they don't understand immediately, they take the easy way out
- "denied".

Thanks to everyone who's replied.

I guess it doesn't hurt to try to get a bank account and see which bank will allow application w/o SSN. Just thought it might be easier for me to withdraw funds here...I'll try Bank of America first, then Wells Fargo. If it doesn't work, that's ok. I'm still hopeful that I'll find a suitable job here.
