Petit Larceny & Green Card: IMPORTANT
Hi,
I was once charged with petit larceny for shoplifting a mere $12 thing. I was told by the judge that if I spend one day in jail, the record would be taken off/expunged. I also called the same jail today and they could not locate my name or social security or anything for me on their record.
I would not want to unncessarily draw attention of my employer, lawyer and officials on my form by replying yes to arrested or convicted bcoz I dont believe I was convicted.
Could someone suggest me whether I can safely reply No since no record for me existed in the jail? However, on second thoughts, I might reply affimative on the green card application as arrested, not convicted. IS this OK? Does this affect my chances of getting a green card. I am also afraid that the lawyers would share this information with my employers and they might not like this information and would not want to retain me?
