Personal mishaps and road to green card
 

Hello;

I have a few questions about getting my wife a green card ass soon as possible. However before I ask these questions I would think it best to give the short version of what happened.

My wife and I met via the internet aproxamately 5 years back...She is Thai and I am American. After 2 years of communicating via internet, phone and private chat..Plaa ( my wife) decided to finish her masters in Florida.... close to where I lived.

After she arrived here..she had two months before she had to start at her college of choice. In that time we sealed what had became somewhat serious over the previous two years.

We had made different plans and she decided to not finish college at the moment. A year later we were married and now we have a little girl added to the family.

Right after we married I was seriously injured at my place of employment...so this forced us to put off getting an immigration lawyer and doing our INS paper work.....Obviously finances were the issue, because we did not know how long this injury or workmens comp case would last.

We thought it would be best to take what monies we had and pay off the remainder of the house and save some for the time I would have to be out of work.

Its good that we did like this because it took two years just to resolve this case...and all we are getting back is 2 years backpay...if that.....So I must return to school now to be retrained at another type of employment , because the doctors refuse to return me to normal lifting or labor..

On my wifes end of the story............................................
She will be losing her visa (expires this month), as well as her drivers licence.

Now ...with the story clear and knowing we will be getting back pay ..........Plaa and I decided we must get her green card
going regardless of our financial situation at the moment.
However we are scared because of how INS has been acting since September 11th.............................................. ......................

My questions are .................................................. .............................

1.)Could they deport my wife now that her Visa has expired...even if we had a child born here together, are married and own a home together?

2.) Who would be the best lawyer in the Tampa Bay area of Florida for the price ( remember our financial situation at the moment)

3.) What would be the best path to follow at this time our given situation

4.) Is ther a way that a lawyer could get my wife an extention on retaining her drivers licence while waiting on her visa? Either by some type of tempory paperwork or documents?

5.) lastly ...what are other alternitives that we can look into
in the mean time?

I would love to say that I absolutly adore my wife and she has been angel....concidering the situation we had be thrown into. I would be extremely grateful for any knowledge and advice given here at this forum.

go to INS site given link http://www.ins.gov/graphics/formsfee.../i-485.htm#fba it will take you to Family-based applications and then click where it says You may download a package of all of these forms in PDF format.
after this all process you will be having all forms to apply for your wife green card. just fill out these forms with supporting documents and total fee will be almost 555 $ that is for the first form I-485 255 $ , form I-130 130 $ , Employment authorization I-765 120 $ , finger printing fee 50 $, just follow the simplw instruction, email me if you face any problems regarding filing.

YOU CAN APPLY BY YOUR SELF I APPLIED NY MY self and its very easy



go to INS site fill out the form and apply once you apply your wife canot be deported until her case result is decided

Hi, I would save the lawyer fees, and file the application yourself. It is
not that difficult. My husband and I filed our adjustment of status papers
ourselves five years ago (in 1997) after we got married without the help of
a lawyer. I also filed my naturalization papers myself without my the help
of a lawyer, and I became a US citizen just about a month ago.

When she failed to enroll full-time in classes for her first term, she
violated her F-1 status. The visa stamp in her passport is *irrelevant* to
the validity of her status in the U.S.

Yes, of course they could, but they probably wouldn't.

I agree with the other posters: you can probably do this yourself. File
Forms I-130/I-485/I-765 at the INS suboffice in Tampa. See
http://www.i-

It depends on your state rules. Your wife may be able to get the license
renewed on presentation of the I-485 receipt notice. It will prove she
holds valid status.

None. This is it. And you are lucky: it is relatively simple, and it
solves a lot of problems.

Thank you all so much for your time in answering my questions......I feel much better knowing that it is not as hard as I thought and that I do not need to pay a lawyer to do all this for us.

I will follow all the sites everyone posted and let you know how it all goes.

As should have been obvious based on the indentation, he was referring
to the post by "Immigration Consultant".
All that poster does is plugging a for-fee site, no matter what the
question is. It is quite annoying.

Ok , well my bad.

I recieved an e-mail that someone replied to me , so when I checked it out....I assumed that you were talking to me.

I am use to forums e-mailing the person that they reply to...but I understand how this is set up now.
