Permission from my daughters father to moveto the US
First i'd like to say hello to you all, i only just joined.
My daughter(14) and i are planning to move to NC (i'm engaged to a US Citizen), and although we have been working on the fiance visa through a US lawyer, i was told i also needed a letter of permission from my daughters father,who sees her maybe once a year and does not contribute at all, we were never married so there is no legal arrangement as such, i wonder if anyone has needed the same "permission" and if not is there any other way i can get through this without going to court to get it?

"Custody Decree: A single parent must present a court decree awarding custody to the applying parent, or a notarized statement from the non-applying parent granting permission for the child(ren) to immigrate to the United States."
You don't need to go to court to get it if the father is willing to give you a notarized statement granting permission. I think the court option is only if the other parent won't give you this notarized statement.

This is a matter related to the convention on international child abduction to which both the US and the UK are signatories.

She wouldn't need permission if he's not on the birth certificate or have any parental responsiblities.

His name is on her birth certificate as we were together when she was a baby and i continued to hope there would be a continuous and healthy relationship between them although this hasn't been the case.

This is what i will attempt to speak to him about tonight although i was told by him that he won't do anything to help me in general, fingers crossed.

Couldn't agree with you more Mr.Folinsky, it has been the basis of raising my children, to always look at the their future when making decisions, weather it be about their basic needs to the relationships they may have with family and the rest of Society. I've tried for 14 years to stress this to my daughters father with very little success and following the very short conversation i had with him last night, having again stressed to him the option of holidays spent with her would always be there i pretty much just got a "right, ok,don't have much to say about that" answer. He has been living in France for a number of years, i wonder if that makes any difference either.

In your first post you say that your daughter's father "doesn't contribute at all". Tell him that if he doesn't give his permission to allow your daughter to move to the US then you will claim maintenance from him to help pay towards her upkeep (it makes no difference that he is living in France). I'm sure he'll come round if he gets hit in his pocket!

Tell him that if he doesn't give his permission to allow your daughter to move to the US then you will claim maintenance from him to help pay towards her upkeep (it makes no difference that he is living in France). I will have to get a nnotarizedletter from a solicitor and hope he will sign it, if not it looks like it will be court wich will be even more distressing for my daughter even though she says she will tell them how she feels about it all i would like to avoid that for her sake.
