Get a good immigration attorney!
I think the problem is you didn't submit any documents to adjust status
I think you can be deported for certain - you are not in any legal status and have not been since your initial visa waiver expired in 1999 (if thats what canadians have)
you have a massive technical overstay and personally right now i would not proceed with the visa spnsership until you have some proper advice

When a Canadian goes over the Bridge at Windsor (or anywhere else) then they don't have to sign a paper or get a I94 or anything right?
Can't you get a divorce from the dickhead, go back to Canada and apply for a k-1 with your new fella?
