Default Not Completed A P85 Yet, Should I Submit It Now?

I moved to the US on an L1 back in November 2010 but I never got round to completing a P85, my company arranged support for all things tax related via a well known accounting firm and while the US side of the organisation have been brilliant the UK side has been equally useless and haven't done anything. I found out about P85s a while ago but never got round to completing it.

Now I'm just finishing up my tax self assessment (I know I'm late!) and I'm wondering if I should send in the P85 now, does anyone have any advise on this?

Also, I initially came over here on a 2 year contract but have since extended this to 3 years, there was a question on my "well known accounting firms" tax questionnaire about whether I had extended my contract since I went overseas. The original length of my US contract has never been declared to HMRC and neither has the extension, any ideas on why they want to know this (I'll guess its a residency related thing) and how I should answer this.

Thanks.

Do it, it lets them know you aren't resident in the UK, so might get a tax refund on income tax and you've got nothing to lose, but it's a simple one to fill in.

I think you can do it up to two years after leaving the UK, so long as you're expecting to be out of the UK for at least three years. We did it and both got refunds.
