next step after K3 approval... help please
Hello, I'm learning the whole process one step at a time; and now that my husband's I-129F was approved, I am preparing for what is next.
First question: After my husband enters the U.S., we file for Adjustment of Status, correct? And what becomes of the I-130 application??? Second question: Apparently we have to file the AOS in person at the district office, which for us would be in Helena, Montana. But seeing there is a sub office near to where I live (Idaho), is it possible to file in person there? Thanks in advance! Kim |

In about two weeks, you should be getting a letter from the National Visa Center that your file has been sent to consulate/embassy. And what becomes of the I-130 application??? Since the K-3 is a non-immigrant visa, you still need I-130 for immigration status. I thought all K-3 AOS had to be filed through the MSC and then sent on to the office that has jurisdiction over you. You need to wait till I-130 is approved and then file for AOS. Check out

Thanks to both of you for your responses. It leaves me confused though, because this site says that I don't need to wait for the I-130 approval before applying for AOS...

A K3 has two years on the visa, so there is no rush. You would simply include a copy of the initial receipt for the I-130 with the AOS package. The AOS won't be approved until the I-130 is approved. And BTW, its generally not a good idea to learn things "one step at a time". Too many opportunities to make mistakes. Mike |

The other possibility is not to file AOS, and just finish the I-130 process at
