Name change at Social Security - Alien Status?
I got married a 3 weeks ago and would like to change the last name on my Social
Security Card to my husband's last name. I came in as a tourist and my I-94 expired 1 week ago. They say they need proof of my Alien Status. The instructions for the corrected social security card say: ALIEN STATUS: We need to see an unexpired document issued to you by the INS, such as Form I-551, I-94, I-688B, or I-766. We CANNOT accept a receipt showing you applied for the document. So when can I actually change my info? I already went to the INS to apply for AOS and everything is under my "married" name. Will this create problems for me in the future? Thanks. |

RM 00203.400 Who Must Submit Evidence of Lawful Alien Status for an SSN Card 2. Replacement SSN Card All applicants who allege a foreign place of birth and/or who are not U.S. citizens must submit evidence of either lawful alien status or INS-granted work authorization for a replacement SSN card, if the Numident for a prior application does not show an IDN of "H." The "Evidence Submitted" block must be annotated to show "IDN=H" in lieu of listing the actual document. RM 00202.235 Form SS-5 - Evidence (IDN) Codes H - The applicant is an alien lawfully admitted for permanent residence. NOTE: An IDN OF "H" on the Numident is sufficient evidence of lawful permanent resident status for a replacement SSN card. RM 00203.450 Evidence of Nonimmigrant Status for an SSN Card A. POLICY - GENERAL Each alien lawfully admitted as a nonimmigrant should have an unexpired INS document as evidence of his/her status. An INS letter, receipt, copy of an application form or any document not listed in this subchapter is not acceptable evidence of alien status in lieu of the appropriate INS document. B. PROCEDURE 1. Evaluating Documents Check both sides of documents issued to nonimmigrants for expiration dates and /or extensions. 2. Expired Documents Do not process the SS-5 when an expired document is submitted since no SSN can be assigned. Return the SS-5 to the applicant and refer the individual to INS. Return mailed-in applications with an SSA-L676 denial notice. 3. INS Receipts Do not process the SS-5 when an INS receipt is submitted since the alien must submit the appropriate INS document issued. I already applied for the EAD and will hopefully get it within two months. I'm glad I won't have to wait one year to straighten out my "name issues". |

sorry, I should have said the SSN office will accept the EAD as authorization to
work, not necessarily valid alien status...however, either way, having an EAD means she is allowed to work and therefore is entitled to a SSN. an I-94 is irrelevant to the SSN office if you have a valid EAD. All they care about is if you are authorized to work and have unexpired proof of such. The links you provided only back up that fact. I'm in CA and I have a feeling they try to make things tougher around here. I already have a SSN and all I want to do is change my name. I would guess the Marriage Certificate should be enough. The problem is my I-94 expired 2 weeks ago, so I don't have any more proof of legal alien status until I get my paperwork from the INS. |
