My Situation in Limbo, Please Help
I have approved 1-360 from my previous marriage. I receive a letter from immigration stating that my approved 1360 is subject to denial if I don’t provide them enough proof that my marriage was good faith marriage.
Now first question is why the immigration is asking for the marriage proof where I have applied the I360 by myself not on behalf of my previous wife?
What legally INS could do or I should do at this moment?
Also I have applied the I-130 and I-485 with me current wife and waiting for an interview, which would take another 12 months or so.
Should I tell ins to stop my previous case?
I would truly be thankful if someone can show me the right path.
Thanks in advance!

I am confused.
What is your current status?
Are you a PR or a USC?
What category of I-360?There are multiple reasons fro filing it.
If you are not a USC, then I don't think your spouse has to wait at
least 6 years for a green card. I don't think she can file to adjust
status and stay in the US for that long.

Re: My Situation in Limbo, Please Help
Well first of all I-360 is for battered spouse and I filed for myself in my previous marriage. I am not a USC and currently I have 2 cases filed with INS. One on behalf of my previous marriage (spouse was abusive so file i-360 by myself) and Second with my current wife who is USC for I-130 and I-485 and the letter which I got is for the reply of approved I-360 and INS is telling me that its intent to be revoked if I don’t supply them enough evidence that my marriage was a good faith marriage.
Now my question was that I-360 what should I do at this moment, should I provide them enough evidence for my previous marriage and then withdraw that case since I have current case going or just withdraw it OR what you think could be the consequences?

Thanks. Now I understand. Howver your first post said you have an
"approved I-360" and you also said you approved I-360 is subject to
denial. I am a bit confused about something that is approved is subject
to denial. In any case, if they ask for proof your previous marriage was
valid, then you have to give it to them. So, I am wondering if your
I-360 is actually "approved".
To me, approved means you are now free to continue as a permanent
resident.
This doesn't appear to be te case. And, if you are approved, why do you
even need the I-130/485 with your present spouse? INS might be
suspicious that you are filing for AOS based on your current marriage,
while you are already in the I-360 process.

YOU SEEM TO KNOW A LOT ABOUT THIS ISSUE, I WOULD LIKE TO ASK YOU ONCE YOU RECEIVE YOU THE I-360 APPROVAL DO U THINK THAT NYC INS WILL INTERVIEW ME OR JUST SEND ME GREEN CARD?
DO YOU THINK THEY ARE GOING TO GIVE ME HARD TIME IF THERE IS AN INTERVEIEW?
THANKS
