Moving to the USA with a job offer?

Hi,
I'm a second year university student based in Surrey and have just finished a month's internship at an advertising agency in San Diego.

I have been offered a full 3 month internship next summer in LA after I have graduated in England. I obviously wish to do so and think it's a J1 or J2 student temp work visa (?).
More importantly I have also been told that since I will have graduated that there is a chance of me being offered a permanent job, where do I stand on getting a visa to do so, I'm guessing it should be possible considering I will be a professional and an American company are offering me a job? What do I do, little help!?

Graduating will not make you a professional me old mucker, it will make you slightly less wet behind the ears

The company that offered you the internship can start the paperwork for J-1 for you H-1B is less likely, plenty of threads about that on here.

When I say professional the job position will be as an Account Executive at an advertising agency, it's not exactly mcdonald's or taco bell lol.

Do I not start the J1 myself and whats an H1B? If the company said that I have to sort it myself, where do I stand?

If you don't even know what a H1B is, you need to do some reading here or at the USCIS website. Google is your friend also.

You cannot organize it yourself - the sponsoring company must do the paperwork for a work visa.

You stand at the -100% side of the ruler. An H-1B visa is a work visa. There is a quota for this visa and application is usually on April 1 and is "sold out" by April 1 noon with a start date of October. Have no clue if an Account Executive with an advertising agency is even on the H-1B category list.

Does that job require a 4-year degree? Can the company make the case for that?

If the company says you have to sort it, find another company. Visa sponsorship is up to them.

The H1-B is subject to an annual cap, and is heavily oversubscribed, so you've got a tough road ahead.

In reality, a junior account exec (which is what the OP would be) in a full service agency is pretty much like working in McDonalds and Taco Hell.

You have precisely zero chance using H1-B - the role is just not specialized enough - and there is an army of potential USC candidates for jobs like this.

I think you need to start by treating the internship as completely separate from the permanent job offer, for a variety of reasons. For one thing, the J visa as I recall is intended to be for a temporary visit and to obtain it you must prove that you intend to return to the UK at the end of the internship. This would involve showing ties to the UK like residence and employment. You cannot under any circumstances mention that the employer might offer you a permanent job - they will deny you straight away for intending to immigrate. Also you need to find out from your employer which version of the J visa they are going to use since I recall some varieties that require that you return to your home country
for a minimum of two years before you can return to work in the USA.

Regarding the H1, yes as others have mentioned it is a bit of a long shot at the moment because of the cap and lottery. Even it it were possible, you would not be able to start work on the H1 until October 2009. However, it is not impossible, depending on the specifics of your job description and what you personally bring to the table that may be in short supply in the USA. There is also a possibility that the H1 visa cap may be increased after the US elections this year (although the actual date of increase wouldn't take effect until 2010 at the earliest).

I would suggest going ahead with the internship but plan to return to the UK afterwards. If the employers are serious about a permanent job find out if they realize the visa implications and timescales involved, have they applied for H1 visas for other employees. Talk to those employees if possible.
