Default Moving to the US - Boyfriend's divorce not through

Hi everyone!

This is my first time here and I have a question.

I want to move to the US to live with my boyfriend. I can't go through the usual fiance visa route as my boyfriend's divorce is not finalised and there is no guarantee it will be before the 90 days are up. Is there a way I can obtain a visa to live and work there while we await the finalisation of his divorce?

We are really anxious to start our lives together and would be grateful for any help anyone can offer.

Simple answer is absolutely no. Sorry. You're going to have to wait
for the final decree.

My wife and I went through the same pain. Her divorce took 14 months more
than necessary.



I used the VWP to fly in and out to be with her but that's a risky way of
doing it. I was lucky on my entries, I told the truth (I'm hopeless at lying
plus I didn't want to mess up any future applications) and was able to get
through but others aren't so lucky.



Having been through the same situation as you, as hard as it may seem, I
would suggest you wait until the divorce is final then apply for the finace
visa. At the moment, there is no way you are able to live and work in the US
unless you find employment here that will sponsor you.



You may still visit under the VWP but entering too much will arouse
suspicion and you may be refused entry, which will cause problems when you
final do apply for a fiance visa.



I know how hard it is to be apart from your partner but if you are not
careful, you could be forced to be apart for a lot longer.

Thank you SB and Froddo - this is so hard for us - US divorces seem to take so long but I guess we'll have to wait - if anyone can think of anything at all please let me know (or if anyone would like to offer me a job in the Boston area LOL!!!!!)

If you have [a lot of] money to spare, there always the option of enrolling
into a US university or graduate school or professional school (depending
on your current educational background and future plans) and getting
a student visa. This will give you a year or a few years together.
