Moving to toronto... via the US

Unhappy Moving to toronto... via the US

Hi folks,

I hope someone can help me, because the US embassy in London website certainly doesnt!

My Wife works in NJ on a H1 visa as an acdemic (she is a brit). I am a brit too (based in London, just finished Ph.D.) and we recently got married.

Our plan is to move to Toronto - I will get a flight from London to Newark, we will hire a truck and drive to Toronto. I'm sure at some point I will return to the UK, but that's all in the future. Also, I will need to visit the US in the future, so I dont want to break the rules for the next time I visit...

Can I do all this on Visa waiver? I'm perfectly happy to buy a return to Newark from London to satisfy the VWP rules and not use the return, and then hand over the I-94 at the border - as it will speed things up not to have to go through the rigmarole of visa applications.... anyone got any thoughts???

The FAQ on the US embassy website seem riddled with inconsistencies....

I think that you can choose between the VWP and an H4 visa, both are
just as good.

Please note that if you go for an H4, once your wife will have moved
to canada, you won't be able to use it anymore

This part of the website seems pretty clear as far as VWP requirements
go.:

"Holding a return or onward ticket. If traveling on an electronic
ticket, a copy of the itinery must be carried for presentation to the
United States Citizenship and Immigration Service (USCIS). Note:
Travelers with onward tickets terminating in Mexico, Canada, Bermuda
or the Caribbean Islands must be legal permanent residents of these
areas;"
