Hi All,

I had a question I was hoping someone may be able to help me with. My husband came
here on a k-1 visa. He has revceived his conditional 2 year Green Card. We are
thinking of moving to his Country (Aruba) and I was wondering if we should still file
the application for the permanent green card.

My concern is, what if the move does not work out or at some point we want to move
back to the states, how would he be able to re-enter. Again, we are just thinking
about it at this point but I would like to be prepared.

Any information would be appreciated.

With a green card you can be out of the country up to a year and it is suggested that you file an I-131 before you leave to obtain a "re-entry document". If you are planning on being out of the country for more time than that, it is very possible that INS will consider his permanent residency abandoned as one must show that one still has residency inside of the US.

You can check to see if the US Consulate for Aruba allows direct consular filing. If he gives up his green card and they allow DCF then you would have to apply there for him to get another green card.

I would also check the responses you received previously on the same subject when you asked not that long ago ;-) Things haven't changed.
