Default Move home to USA

Has anyone moved to the UK to marry their partner and after a period of years you both decided to return back to the USA?

Have anyone faced any complications like they do returning home to the UK
Like they have to meet Financial Requirements of £62,500.00 saving to be cleared Entry along with their Spouse visa.

Are there any Requirements you have to meet in which to leave the UK and return home to the USA?

I assume one of you is a USC?

If so, then it's possible, and not very complicated. Yes, there is a financial requirement for the USC, but there are ways around it, such as using assets or a joint sponsor.

You'll want to research the terms "Immigrant Visa", and also "I-864 Affidavit of Support".

The US is easier from a financial support requirement than currently required by UK. The US support requirement is lower than the UK (income at 125% above the poverty level (about $18,000 for a family of two) or 3x that amount in liquid assets or a combination of both. If that can't be met, then a joint sponsor (any USC or LPR over the age of 18 that has that minimum income for his family plus the immigrant) can be used for the affidavit of support.

Yes, Mrs P and I did that. We are far from unique.

Yes, there are similar requirements, though (i) the thresholds are lower, and (ii) use of a joint sponsor is permitted.

There are no exit requirements for leaving the UK. Legal residents and citizens can leave at any time, with no need to formally notify anyone, though if you notify HMR&C you may be eligible for a tax refund. There are no requirements for a USC to return to the US at any time.

Maybe get your UK citizenship before coming back to US, that way it's easier to move back if you want to in the future.

Many Thanks for your replies and information:

So for a US Citizen to return back home from the UK to the US with their married partner they require to have

1: Spouse Visa
2: $18,000.00 / £12,000.00 in savings

to be cleared entry into the US, is this correct?

That figure is annual income. The savings figure is three times as much. To be clear, the requirement is either income OR savings, or some pro rata combination e.g. two thirds income ($12,000) and one third savings ($18,000).

When you Plan to move from the UK back home to the US, you may not have a job to return to in the US, so there will be no Annual Income!

All your liable to have is savings!

So you will require to meet a Financial savings of $54,000.00 / £36,000.00 to be allowed back home into the US with your married partner ?

That is correct. (BTW Coming into the UK it is much worse - £62,500 in savings, and no joint sponsor allowed!)

The alternatives are to have your USC spouse "go ahead" and get a job in the US, and then apply for a visa, or use a joint sponsor, who must be a legal US resident and who would typically, but not necessarily, be a relative of the USC.

Someone here recently reported emigrating from Italy with a USC spouse, and the USC spouse's non-continuing income in Italy was accepted by the US consulate in Rome, but I don't recall hearing if that was the correct treatment or if it was an error (I suspect the latter, but don't know for sure.)

Therefore if we both decided to return back to US and did not have the savings, my wife being the US citizen, if she returned to the US alone and found a job and her annual income reached $18,000.00 / £12,000.00 or more all we need then is the visa for me to be cleared entry into the US to join her?

That is my understanding. Hopefully someone else will be along soon to confirm that.

many thanks for your time and information you provided me with, regardless it is not plain sailing to be allowed to return home to US with just a visa but not so Harsh as returning to the UK!

You are allowed 'with just a visa' - the financial requirements are part of the process of applying for the visa - unless you meed the requirements (financial, medical etc) you won't be granted a visa.

Have a look over in the marriage based section and you'll be able to read up in detail about the visa process.
