Default moral turpitude

If somebody files for a marriage based greencard,

And the alien got arrested on a felony charge here in the usa when he was 18 years old,he is now 22 years old.
there was never a conviction for the charge,he got in to the
pretrial intervention program for 18 months,and never got convicted.

My question is ,does he still need to send a 601 hardship waiver
with his I-485.

I am very thankfull for any advise.
