HI 00801.008 HI Entitlement for Aged Spouse of Age 62 Worker
B. POLICY
HI eligibility for the age 65 or over spouse of a 62-year old worker begins with the month an insured worker attains age 62, rather than the first month throughout which the worker is age 62.
Neither the worker nor the spouse need actually establish entitlement to monthly benefits for this provision to apply. If the worker would have been eligible for RIB in the month he/she attained age 62 except for the fact that he/she was not age 62 throughout the month, the age 65 or over spouse can file for and establish entitlement to HI for the month the worker attained age 62.

HI 00801.131 Eligibility for Premium-HI
A. Requirements for Entitlement
To become entitled to Premium-HI, an individual must:
1. have attained age 65 (see GN 00302.005); and
2. be a resident of the U.S. and either:
1. a citizen or
2. an alien lawfully admitted for permanent residence who has resided in the U.S. continuously for the 5-year period immediately preceding the month all other requirements are met; see GN 00303.000ff; and
3. be ineligible for HI under any other provision; and
4. already have SMI coverage or be eligible for SMI enrollment and file an enrollment request which will entitle him to SMI (see B. and HI 00801.133) and
5. file an application for HI during a prescribed enrollment period
B. Mandatory SMI Coverage
An individual may not enroll in Premium-HI without an existing or simultaneous enrollment in SMI. Further, the termination of an individual's SMI coverage requires a simultaneous termination of Premium-HI coverage.

4. 5-Year U.S. Residency
In addition to establishing U.S. residency, the alien must have continuously resided in the U.S. for the 5-year period immediately preceding the month of effective enrollment (or effective filing for deemed HI). The alien need not have had LAPR status during this 5-year period.
The 5-year period of U.S. residency begins the day the NH arrives in the U.S. with the intention of establishing a home. Arrival as a visitor or tourist does not begin a period of residence.

B. PROCEDURE
If divorce or remarriage results in the loss of HI eligibility under the regular insured provision, determine whether the individual is eligible for HI under the deemed insured provision or, if in a prescribed enrollment period, wishes to enroll for Premium-HI.
Note From Me: Must have been married for 10 years to qualify divorced spouse benefits or 9 months to qualify for widow/er's benefits.

The 2009 Part A premium is $443.00 per month for people who are not otherwise eligible for premium-free hospital insurance and have less than 30 quarters of Medicare-covered employment.
