Hi,

Our situation is this:

I have been married to a US citizen for 14 months and we are currently in the UK. My wife may have to return to the USA (Puerto Rico) to begin a job and I was wondering if anyone had any information on if the K-3 Visa would be a good way for me to get to the USA as her spouse. I know about applying for a spousal visa here in the UK but the timeframe may not be quick enough (before she needs to start working).

I believe that the initial I-130 would have to be filed at Vermont (not sure about the K-3 visa). Does anyone have any timelines for applying for a K-3 visa as a spouse?

Is the K-3 visa a good way for us to go?

Can I travel to the USA on the Visa Waiver program during the visa application process?

Any other advice / information would be greatly appreciated.

You're a perfect candidate for a K-3 Visa. And, yes, you can travel to the US on a
visa waiver while the process is pending.
